VAN DEVANTER, Circuit Judge.

This was an action to recover a penalty for an alleged failure to comply with the provisions of section 1 of the act of June 29, 1906, c. 3594, 34 Stat. 607 (U. S. Comp. *70St. Supp. 1907, p. 918), known as the “28-hour law.” The verdict and judgment were against the defendant, and it prosecutes this writ of error.

The alleged failure to comply with the statute occurred in what was then the Indian Territory, and not in the district wherein the action was brought and tried. Because of this, it is urged that the Circuit Court was without jurisdiction; the argument being…
