OPINION AND ORDER

HEWITT, Judge.

Plaintiff Commonwealth Edison Company (ComEd) seeks damages from defendant for partial breach of a contract to dispose of nuclear waste that had been produced at plaintiffs nuclear power plants. See Complaint (Compl.) HIT 35-38. Plaintiff also seeks damages for the taking of its real property without just compensation. See Compl. UH 48-51.
