GOODRICH, Circuit Judge.

Philip Frank Mancuso was indicted and convicted in the court below upon the charge that he failed to appear and present himself for induction into the United States Army upon order of his Local Board in violation of the provisions of the Selective Training and Service Act of 1940. 50 U.S.C.A.Appendix, § 311. This conviction came as a culmination of a series of incidents which could be called a comedy of errors were the subject not so serious both for the defendant and the public welfare.
