In support of its contention that the release executed by appellee was binding on him, and that the court therefor should have instructed a verdict in its favor, appellant refers (1) to undisputed testimony in the record showing that the hospital association mentioned in the statement above was incorporated under the laws of this state as a benevolent or charitable society without capital stock, that the funds necessary to pay the expenses of the association were obtained by assessments against its members; and that Drs.
