Plaintiff in error, Cowan, in an accident caused by the actionable negligence of defendant in error, Electric Railway Company, received’ permanent personal injuries for which he recovered damages in one of the district courts of El Paso county. The Court of Civil Appeals at El Paso reversed the judgment of the district court and rendered judgment in favor of the Electric Railway Company on the ground that Cowan, prior to the filing 'of the suit, had executed to the Electric Railway Company a full release for aR damages. 257 S.
