Error to the Court of Civil Appeals for the Second District, in an appeal from Cooke County. Huyett sued the railway company and had judgment which' was affirmed on appeal by the defendant, who then obtained a writ of error.

WILLIAMS, Associate Justice.

The defendant in error, who had received personal injuries while in the service of plaintiff in error, in consideration of the payment by the latter of the sum of $250, executed to it a release of all damages thus sustained. He subsequently brought this suit to recover such damages, wherein he sought to avoid the release on the ground that it was obtained by a misrepresentation made to him by one of the surgeons of the railroad company, engaged in treating him in its hospital, as to the nature and extent of his injuries and as to his recovery therefrom.
