ALBRIGHT, Justice:

This is an appeal by Nationwide Mutual Insurance Company from an order of the Circuit Court of Nicholas County in a civil action alleging violations of W.Va.Code § 31-11-4(9), relating to unfair insurance claim settlement practices. The order denied Nationwide’s motion for judgment notwithstanding the verdict or, in the alternative, for a new trial, after a jury verdict was returned against Nationwide in the case.
