Background

Dale Wayne Fulmer was indicted for the offense of continuous sexual abuse of a child under the age of fourteen. Tex. Penal Code Ann. § 21.02 (West 2011). The indictment charged Fulmer with committing two or more acts of sexual abuse against a child younger than fourteen, namely by aggravated sexual assault and indecency with the child. The indictment did not specify the county in which the acts occurred.
