— The State appeals the dismissal on the basis of the speedy trial rule, CrR 3.3 in effect between November 17, 1978 and August 1, 1980, of cases against respondents Brian Schmidt, Shannon Wright, and Roger Marlatt. In each case the dismissal resulted from an application of the rule announced in State v. Edwards, 94 Wn.2d 208, 616 P.2d 620 (1980), to cases tried before August 21, 1980, the date on which Edwards was issued. Each defendant complained that the failure to have a preliminary hearing within 100 days of arrest violated CrR 3.3 as interpreted in Edwards, even though trial occurred…
