Appellant appeals from an order granting summary judgment in favor of respondents on Count II of his petition and an earlier dismissal of Count I of his petition. Appellant asserts two points on appeal: 1) the trial court erred in sustaining respondents’ motion for summary judgment on Count II which alleges premises liability based on control for the reason that appellant presented sufficient facts to establish a genuine issue concerning the question of respondents’ retaining sufficient possession and control of the premises so that respondents owed a duty of reason able care to…
