JOHNSON, Chief Justice.

This suit is by Clara Belle Ingram against the City of Tyler to recover damages for personal injuries alleged to have been sustained as the*result of defendant’s negligence.

On September 30, 1938, and at all times here material, the city of Tyler owned and operated a public park consisting of about six acres located within the corporate limits and known as Bergfeld Park.
