This is an action in damages, instituted in the district court of Harris county, Tex., by J. H. Cawthorn against the city of Houston, in which the plaintiff sought judgment in the sum of $30,000 for alleged personal injuries sustained by him on or about June *70213, 1916, as the result of defendant’s negligence. The original petition is copied in full in the opinion of the Court of Civil Appeals, and no useful purpose would be subserved by-recital of details here, especially as they have no important bearing upon the controlling questions on this appeal.
