Respondent sued appellant for libel and recovered a judgment for $1,000 general damages, $1,000 exemplary damages, and costs. A motion for new trial was denied and this appeal was taken.

From 1942 until 1946, the litigants were partners in a business which dealt in articles and devices used by magicians. During appellant’s absence at the war respondent carried on the business. After appellant’s return differences arose between them and a suit was brought by appellant against respondent for a dissolution and an accounting.
