This action was brought in the County Court of Richland County by William DeTreville and others against the Mayor and Councilmen of the Town of Forest Acres to enjoin tfye enforcement of the following ordinance which was enacted by the Town on March 7, 1950:

“Section 1. That.it shall be unlawful for any person, firm, corporation or water district to sell water except water purchased from the Town of Forest Acres or Public Works Commission thereof, for use in any home, business place or 'elsewhere within the limits of the Town of Forest Acres.
