The Cairo Flour Company, a partnership, instituted this proceeding against the Provident National Bank of Waco, by a writ of garnishment which required the defendant to answer upon oath what, if anything, it was. indebted to one S. J. Hawkins, against whom the plaintiff, Cairo Flour Company, had a judgment. The writ of garnishment also required the bank to answer as to other matters which are not involved in this appeal. The bank answered under oath, negativing the existence of all facts which would show that the plaintiff was entitled to any judgment against it as garnishee. The…
