I. INTRODUCTION

Plaintiff John Hancock Mutual Life Insurance Company (“John Hancock”) brings an action against defendant under Section 301(a) of the Labor Management Relations Act, 29 U.S.C. § 185(a) on one federal cause of action, and two state causes of action. First, plaintiff claims that the defendant Barbara L. Austin (“Austin”) violated a Covenant Not to Compete within a Collective Bargaining Agreement.
