OPINION

ANDERSON, Chief Judge.

Douglas Krueger appeals from a judgment against him on his claim for the proceeds of a fire insurance policy. Before trial, the court dismissed all of Krueger’s claims except for his breach of contract claim and denied respondent’s motion to dismiss for insufficient service of process. During trial, the court denied Krueger’s motion to elicit evidence of nonprosecution for arson.
