This is a suit by an insurance company to recover the amount paid by it as an insurer, the money having been received from a tort-feasor by the administrator.

On October 30, 1951, the plaintiff, Iowa National Mutual Insurance Company, insured in favor of Signe Caroline Huntley a Lincoln automobile against damage by collision with other vehicles, Mrs. Huntley owning the automobile. In the early part of 1952, Huntley and his wife were involved in an accident in Nebraska, the automobile colliding with a truck of the Snowden Transfer Company, hereinafter named as the tort-feasor.
