MEMORANDUM DECISION AND ORDER
SPATT, District Judge.
This case concerns allegations of fraud and breach of contract by Plaintiff, Pacs Industries, Inc. (“Pacs”), against Defendants Cutler-Hammer, Inc. (“Cutler”). Presently before the Court is Cutler’s motion for judgment on the pleadings pursuant to Fed.R.Civ.P. 12(c).
BACKGROUND
The facts of this case can be briefly stated. In December 1994, Pacs was awarded a contract for the installation of a power plant in the Philippines. In March 1995, Pacs purchased a “busway,” one of the components necessary for the project, from Cutler for $22,050.…
