Appellants, Daryl Stewart and Audrey Herbst, brought this action to challenge the Bureau of Prisons’ (“BOP”) policy of refusing to consider for jobs within correctional facilities any applicant who is over thirty-four years of age.1 Appellants contend that BOP’s policy (1) violates the Age Discrimination in Employment Act, 29 U.S.C. § 633a (“ADEA”); (2) is arbitrary and capricious and thus invalid under the Administrative Procedure Act (“APA”), 5 U.S.C. § 706(2)(A); and (3)…
