This appeal is from a judgment of conviction, rendered on the verdict of a jury finding Herman Woodruff, “the defendant, guilty of attempt to< rape as charged, and fixed his punishment at confinement in the penitentiary for one year,” alleged in the information to have been committed in Caddo county, on the 17th day of May, 1940, on Dorothy Hamilton, a female person of the age of IB years, and not the wife of the said defendant.
