The plaintiffs, as heirs at law o£ Theodore Hidden, brought this action for damages resulting from his death, which was caused by injuries sustained in an accident when he was struck by an automobile driven by the defendant George Malinoff. The plaintiffs based their cause of action upon alleged negligence of the defendant George Malinoff. The defendants denied this accusation of negligence and pleaded contributory negligence on the part of the deceased and unavoidable accident. The issues were tried by a jury which rendered a verdict in favor of the defendants.…
