Before this court is plaintiffs civil rights action pursuant to 42 U.S.C. § 1983 against defendant Thomas A. Coughlin, III, (“Coughlin”), Commissioner of the New York State Department of Correctional Services; Stephen Dalsheim (“Dalsheim”), Superintendent at Downstate Correctional Facility (“Downstate”); Donald McLaughlin (“McLaughlin”), First Deputy Superintendent at Downstate, and Correction Officers Sawyer (“Sawyer”) and Pucher (“Pucher”).
