MEMORANDUM

ECHOLS, District Judge.

Pending before the Court is the Petition for Writ of Habeas Corpus filed under 28 U.S.C. § 2254 by Petitioner, Tommy King (“King”). 1 (Docket Entry No. 26.) Respondent, Warden Ricky Bell (“the State”), filed an Answer to the Petition (Docket Entry No. 49) and later filed a Motion for Summary Judgment (Docket Entry No. 53), to which King responded in opposition.
