This is a motion for a preliminary injunction against the alleged infringement of the second claim of letters patent commonly called the “incandescent lamp” or the “filament” patent, (No. 223,89S,) dated January 27, 1880, to Thomas A. Edison. The patent has been, directly and indirectly, the subject *359of exhaustive investigation before the courts of this country, and was carefully examined by the United States circuit court of appeals for this circuit in the case of Edison Electric Light Co. v.
