SWYGERT, Chief Judge.

This opinion shall be deemed the Court’s findings of fact and conclusions of law.

*742There are forty-five plaintiffs in this action, seeking compensation from the defendant, Standard Oil Company, for the overtime hours they worked at various times between April, 1942 and December, 1945. Their claims are based on the Fair Labor Standards Act of 1938, as amended 29 U.S.C.A. § 201 et seq.

After a motion by the defendant for summary judgment was denied, counsel for all parties agreed to select from the named plaintiffs those claims which were somewhat representative of all the…
