The following statement and questions are certified for decision by the Court of Civil Appeals for the Fifth District:

“A. M. Stubbs and wife resided with their minor children at Wortham, Texas. Mr. and Mrs. Stubbs owned, in community, three lots situated in said town. One of the lots constituted the residence homestead. The other two lots were business properties.
