State of Oklahoma ex rel. O. B, Mothersead, Bank Commissioner of state of Oklahoma, brought suit in district court of Oklahoma county, Okla., against M. V. Van Meter for recovery of balance due on a promissory note executed by Van Meter to First State Bank of Bristow on July 17, 1922, for the sum of $3,500, due and payable on December 17th of the same year, and provided for ten per cent, attorney’s fee in event of default. There appeared on said note a credit of $1,182.65 as of August 9, 1922.
