(after stating the facts as above). During the progress of the trial counsel for the defendant offered to prove by several witnesses that about six or eight months before the homicide the deceased had been arrested and lodged in jail on charges of hog stealing and larceny of merchandise from private residences in the Rufe neighborhood, and that it had been frequently and openly discussed at that time by numerous persons in that neighborhood that the deceased would be killed if he got out of jail, and further that at the time of the homicide the deceased was at large on bail pending trial for…
