Plaintiff in error, hereinafter called defendant, was convicted in the district court of Garfield county of the crime of murder in the killing of Jessie Griffith, and his punishment fixed by the jury at death.

Defendant was originally convicted in the district court of Kay county of the crime of murder, and his punishment fixed by the jury at death. On November 29, 1932, this court reversed that case, with directions to the court to grant a change of venue (Quinn v. State, 51 Okla. Cr. 179, 16 Pac.
