Plaintiff in error, Rollie Fleetwood, was charged by information in the district court of Tulsa county, Oklahoma, with the crime of murder committed in said county on his 72-year old father, Sherman Fleetwood. The offense was alleged to have been committed some time during the day on Sunday, December 25, 1949, by means of three shotgun wounds. The scene of the crime was the Sherman Fleetwood farm, a few miles south east of Bixby, Oklahoma, in Tulsa county. The defendant was tried by a jury, convicted and his sentence fixed at the death penalty, and judgment and sentence entered accordingly.…
