The case before us here involves principally a problem in devolution of command. Tried by a general court-martial sitting in Korea under a specification alleging desertion, in violation of Article 85, Uniform Code of Military Justice, 50 USC § 679, the accused, Williams, was found guilty as charged. He was sentenced to be dishonorably discharged from the service, to forfeit all pay and allowances, and to be confined at hard labor for ten years.
