This is a malpractice action.

In 1946, plaintiff Everett Huttner suffered a generalized convulsion, and his condition was diagnosed as a low level of epilepsy. In 1947, he suffered another convulsion of the same type. In October, 1949, he contracted a cold, which was accompanied by severe headaches. Thereafter, he suffered diplopia (double vision) in one eye and consulted an ophthalmologist, who made an examination of his eyes and changed the lenses in his glasses.
