The appellants, (who were the defendants below), Brosius Development Corporation and Brosius Homes of Hagerstown, Inc. (closely affiliated corporations, hereinafter referred to as “Brosius”) were the owners and developers of a subdivision known as Greystone Manor in the north central part of the City of Hagerstown, (“the City”), the appellee. The City and Brosius agreed that the City would install the sewers in Greystone Manor, toward the expense of which Brosius paid the City $12,000.
