In an action, inter alia, to recover *745damages for fraud, defendants appeal, as limited by their brief, from so much of an order of the Supreme Court, Suffolk County (Mclnerney, J.), dated August 15, 1984, as denied their motion made pursuant to CPLR 3211 (a) (7), to dismiss the complaint on the ground that it failed to state a cause of action.
Ordered modified, on the law, by granting the motion to the extent that the first, second and third causes of action of the complaint are dismissed. As so modified, order affirmed insofar as appealed from, with costs to defendants.
