This appeal is from an order which, upon motion pursuant to 3211 (subd. [a], par. 7) of the Civil Practice Law and Rules, dismissed plaintiffs’ complaint and each of the three causes of action therein upon the ground that there was a failure to state any cause of action.
The action was brought by the plaintiffs as 50% shareholders in several related family close corporations engaged in conducting a chain of supermarkets in New York City with the prominent use of the family name “D’Agostino” in the names and businesses of the corporations.
