Edwards, J.), entered December 19, 1989, which granted defendant’s cross-motion for summary judgment as to plaintiffs first, second and third causes of action, granted plaintiffs motion to amend the complaint to assert the proposed fourth and fifth causes of action, and denied leave to amend the complaint to assert the proposed first, second, third, sixth, seventh, eighth and ninth causes of action, unanimously modified, on the law, to the extent of denying leave to amend the complaint and, except as so modified, affirmed, without costs.
