GALLAGHER, Chief Justice.

This suit was instituted by appellee, W. H. Norris Lumber Company, a corporation, against appellant, Matt Hogan and wife, Vernie Hogan, to recover a balance of $766, with interest and attorney’s fees, alleged to be unpaid on a note in the sum of $1,000,. given by appellants to D. E. Lyall, and to foreclose a mechanic’s lien given by them to secure the same on a lot of land in the city of Ennis, known as the Douthett lot. Said note and lien were dated March I, 1929.
