This is a suit by a subcontractor upon a bond given to the United States by the principal contractor to insure the faithful performance of certain work. It is brought in the Eastern district of Pennsylvania against both principal and surety, but the surety alone has made defense. Judgment is resisted! on three grounds; one being that the suit has been pre*242maturely brought,-and another that in any event it has been brought in the wrong district.
