The plaintiff in error brought this action at law against the defendant in error in the Circuit Court for the District of Montana. Jurisdiction was based solely on the diversity of citizenship of the parties. The plaintiff was a citizen of Utah and the defendant a citizen of New York. The judge of,the Circuit Court dismissed the action for want of jurisdiction, and whether that decision was correct is the single question brought directly here by writ of error.
