Action in the district court for Le Sueur county by plaintiff, a minor, through her guardian ad litem, to recover $5,000 for an alleged criminal assault upon her person committed by defendant. The ease was tried before Cadwell, J., and a jury, which rendered a verdict in favor of plaintiff for $1,000. The court made an order granting a motion for a new trial unless plaintiff consented to a reduction of the verdict to $700. Plaintiff having consented to the reduction, defendant appealed from the order.

This is a civil action to recover damages for an alleged assault and battery upon the plaintiff. Plaintiff had a verdict. A motion for a new trial was denied, and this appeal challenges the sufficiency of the evidence to sustain the verdict; likewise the correctness of two instructions given at the request of plaintiff, and the refusal of one asked by defendant.
