District 111, Lodge 1076, International Association of Machinists and Aerospace Workers, AFL-CIO (the Union) represented the employees at Burkart Foam, Inc. (Burkart) during 1984 and 1985 when the employees were negotiating for a new contract with Burkart. The Union initiated unfair labor practice charges against Bur-kart, alleging that Burkart had violated sections 8(a)(1) and (5) of the National Labor Relations Act by refusing to sign the collective bargaining agreement and by refusing to provide the Union with information regarding Burkart’s employees.…
