OPINION

ZAPPALA, Justice.

This is an appeal by the Commonwealth from an Order of the Superior Court en banc which vacated the judgment of *332sentence of the Court of Common Pleas of Philadelphia County and reversed the underlying convictions. The Superior Court concluded that Appellee Baxter Hawk’s constitutional right to a speedy trial was violated, 390 Pa.Super. 382, 568 A.2d 953. For the reasons which follow, the Order of the Superior Court is affirmed; however, we do so based upon Pa.R.Crim.P. 1100.1
