Plaintiff, Sears, Roebuck and Company, is a corporation authorized to do business in the state of Washington, selling goods, wares, and merchandise of various sorts. Defendant George Nicholas is the owner of a two-story frame building in the town of Republic, Ferry county, using the street floor for store purposes. December 31, 1936, Mr. Nicholas leased the upper story of the building to defendant George Atkins, who furnished the same and for some time operated the upper floor as a rooming house.
