OPINION

{¶ 1} This matter is on appeal from the denial of appellant's petition for post conviction relief and request for findings of fact and conclusions of law.

STATEMENT OF LAW AND CASE

{¶ 2} On November 13, 2006, appellant, Jeremy Riley was indicted by the Stark County Grand jury for having committed one count of aggravated vehicular homicide in violation of R.C. 2903.06(A)(2), a third degree felony, and three counts of vehicular assault in violation of R.C. 2903.08(A)(2), each a fourth degree felony.
