ROBB, P.J.

{¶ 1} Defendant-Appellant Jonathan L. Clay appeals the decision of the Mahoning County Common Pleas Court denying his petition for postconviction relief. He filed the petition nine years after the trial transcripts were filed in the direct appeal of his aggravated murder conviction. Appellant argues the trial court failed to hold an evidentiary hearing and denied his petition without declaring it untimely or issuing findings of fact and conclusions of law.
