Appeal from a judgment of the County Court of Albany County (Breslin, J.), rendered December 19, 2007, convicting defendant upon his plea of guilty of the crime of criminal possession of a weapon in the second degree.

Defendant was charged in a four-count indictment with two counts of criminal possession of a weapon in the second degree, attempted assault in the first degree and criminal use of a firearm in the second degree.* As pretrial hearings were about to begin, defendant agreed to enter a guilty plea to criminal possession of a weapon in the second degree and waive his right *1195to appeal…
