Appeal from a judgment of the County Court of Saratoga County (Scarano, J.), rendered March 2, 2009, convicting defendant upon his plea of guilty of the crime of rape in the third degree.
Pursuant to a negotiated plea, defendant waived indictment and pleaded guilty to rape in the third degree based upon allegations that he had sexual intercourse with a female who was under the age of 17 and a biological relative.
