Appeal from a judgment of the County Court of Albany County (Breslin, J.), rendered February 9, 2006, convicting defendant upon his plea of guilty of the crime of criminal possession of a controlled substance in the fourth degree.

Defendant was charged in a five-count indictment with criminal possession of a controlled substance in the third degree (four counts) and criminally using drug paraphernalia and thereafter pleaded guilty to one count of criminal possession of a controlled substance in the fourth degree in full satisfaction thereof.
