This interlocutory appeal arises from the trial court’s denial of a motion to compel a nonsignatory to a contract to arbitrate under the Federal Arbitration Act (“FAA”) and from the trial court’s denial of a motion to abate. In four issues, appellant Mark Carr contends the trial court erred in denying his motion to compel Main Carr Development, LLC (“MCD”) to arbitrate because: MCD is a third-party beneficiary of a contract containing an arbitration clause, MCD is estopped from avoiding arbitration, and MCD is the agent of a party to the contract…
